what is a free church?

A free church is a church that is free from government control and falls under the true definition of separation of church and state. Most churches incorporate and use tax code 501(c)(3). By doing this, they have voluntarily contracted with the government and gave up certain constitutional rights, while simultaneously agreeing to follow public laws and regulations. This is why we saw so many churches, shut down, or follow covid mandates. 

what is 508(C)(1)(A)?

508(c)(1)(a) is a tax code specifically for churches that need an EIN  (no church should ever be under a 501(c)(3) tax code) and exempts you from the rules and requirements of a 501(c)(3). Most importantly it does not put you in contract with the government the way a 501(c)(3) does. A church is never required to be under any tax code or to apply for anything from the Government to be a church or have tax-exempt status but if you want your church to have a bank account or to receive electronic payments of any kind you will need to get an EIN. When you get an EIN you apply under the 508(c)(1)(a) tax code. If you do not want a bank account then you do not need to apply under any code and are simply a free church.

does my church need to Follow rules or look like a "normal" church.

  • Your church can be a traditional Christian church to a church that has a belief in nature and anything in between. 
  • A church can be founded on ANY belief.
  • A church can have as little as 2 members. 
  • No one including the government and the IRS can define your church.
  • The government and the IRS can not regulate a church, unless, of course, you give those rights away (incorporation and 501(c)(3) status). 


The Establishment Clause prevents the government from making a law related to "an establishment of religion," which means that it cannot endorse a certain religion or become entangled in religious activities. This essentially describes the separation of church and state that is fundamental to American democracy.


There are guidelines the IRS follows that they attribute to a church but those guidelines are broad and anyone with a belief in something that wishes to start a church can easily fall under most if not all of those guidelines. We can counsel you on how to meet those guidelines.

A trust is primarily a vehicle for financial and estate planning and asset protection.  


A trust is commonly established so that your assets can be used for the benefit of your beneficiaries without the need for a will and bypassing the process of probate and the probate courts. 


A will is interpreted by the probate courts and in almost all cases your estate will  be devalued with the probate process and the fees associated with the  probate court, even allowing the state to take their own piece of your estate. 


 A trust is governed by State law whereas a properly formed PMA is in the private domain and remains outside of the jurisdiction of the State. They are 2 entirely different entities. 


A properly formed free church PMA has all of the benefits of a trust as far as protecting property and assets but in addition, also protects the activities of the founders and members of the PMA without being governed by State or federal laws.


free church PMas also are tax exempt. You will not have to pay property tax on the assets protected under your free church PMA. If you choose to create projects ("businesses" is the word that would be used in the public domain) under your PMA you are also not required to pay taxes of any kind and do not even have to file anything at the end of the year. Tax-free status is an amazing benefit that a trust does not offer you.
